These Terms of Service ("Terms") govern your access to and use of the websites, tools, calculators, and services (collectively, the "Services") operated by The Gap Funding Group LLC ("Company," "we," "us," or "our"), a Delaware Limited Liability Company. By accessing or using any of the Sites or Services, you ("you" or "User") agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
Your agreement to these Terms is formed by your use of the Services (browse-wrap) or, where applicable, by clicking "I agree," checking an acceptance box, or submitting a form that references these Terms (click-wrap). In either case, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. User Representations
By using the Services, you represent and warrant that:
- You are at least 18 years of age, or you are at least 13 years of age and are using the Services with the knowledge of a parent or legal guardian
- Any information you voluntarily provide to us (including email address, scholarship applications, and contact form submissions) is truthful and accurate
- You are located in the United States or are researching educational programs in the United States
- You are using the Services for your own personal, non-commercial informational purposes unless you have entered into a separate written agreement with us (such as an embed or white-label agreement)
- You will not use the Services in any manner that violates these Terms or any applicable law or regulation
2. Description of Services
The Company operates educational websites that provide information, data, tools, and resources related to graduate and professional school costs, federal student loan limits, and private student lending. Our Services include:
- Educational Content: Articles, guides, data reports, and other informational content about student loan regulations, tuition costs, and financial planning for higher education.
- Funding Gap Calculator: An interactive tool that estimates the difference between a student's total cost of attendance at a specific institution and the applicable federal student loan limits. Calculator results are estimates based on publicly available institutional data and should not be construed as a guarantee of actual costs or loan eligibility.
- Lender Comparison Information: Tables, links, and references to third-party private student loan providers. We are not a lender, loan broker, or financial advisor. We do not originate, underwrite, fund, or service any loans.
Access to the Sites and use of the Calculator and all other tools is currently provided to you free of charge. We reserve the right to introduce paid features or services in the future, which would be subject to separate terms and clearly identified prior to any charge.
3. Not Financial, Legal, or Tax Advice
The information provided through our Services is for general educational and informational purposes only and does not constitute financial, legal, tax, investment, or other professional advice. You should not rely on our content or calculator results as a substitute for professional advice tailored to your individual circumstances.
Specifically:
- Calculator estimates are based on publicly available cost-of-attendance data and federally established loan limits. Actual costs, financial aid packages, loan eligibility, interest rates, and repayment terms vary based on individual circumstances including creditworthiness, enrollment status, and institutional policies.
- References to specific laws, regulations, or policies (including but not limited to Public Law 119-21, the "One Big Beautiful Bill Act") are provided for informational purposes and may not reflect the most current legal developments. We are not attorneys and do not provide legal interpretations.
- You should consult a qualified financial advisor, student loan counselor, or attorney before making borrowing, enrollment, or financial planning decisions.
4. Affiliate Relationships and Compensation Disclosure
Some of the links on our Sites are affiliate links to third-party lenders, loan marketplaces, and financial service providers ("Partners"). When you click on these links and take qualifying actions (such as checking your rate, submitting an application, or funding a loan), we may receive compensation from the Partner. You are not charged a separate fee for clicking an affiliate link on our Sites; our compensation comes from the Partner, not from you.
This compensation may influence:
- Which Partners appear on our Sites
- The order in which Partners are displayed
- The prominence of Partner placement
This compensation does not influence:
- The data presented in our calculator tools
- The editorial content of our articles and guides
- The cost-of-attendance or federal loan limit figures we report
We strive to present accurate, useful information regardless of our affiliate relationships. However, we do not feature every lender or loan product available in the marketplace, and our Sites should not be understood as a comprehensive listing of all available options.

5. Third-Party Products and Services
Our Sites contain links to third-party websites, products, and services that are not owned or controlled by the Company. We are not responsible for:
- The content, accuracy, or opinions expressed on third-party websites
- The privacy practices or terms of service of third-party websites
- The availability, terms, rates, fees, or conditions of any third-party product or service
- Any transactions you enter into with third parties, including loan applications, rate checks, and loan agreements
When you click on a link to a third-party website, you leave our Site and are subject to the third party's terms and conditions. We encourage you to read the terms of service and privacy policy of any third-party website you visit.
We make no representations or warranties regarding the products or services offered by our Partners or any other third party. Any reliance you place on information provided by third parties is strictly at your own risk.
6. Calculator Tool Disclaimer
The Funding Gap Calculator and any related tools available on our Sites are provided as educational estimation tools only. By using the Calculator, you acknowledge and agree that:
- Data Sources: Calculator results are derived from publicly available cost-of-attendance data collected from institutional websites. This data may be outdated, incomplete, or inaccurate. We aim to review and update our data at least annually, typically when institutions publish new academic year cost-of-attendance figures, but we do not guarantee any specific update schedule or real-time accuracy.
- Estimates Only: Calculator results are estimates and should not be relied upon as precise figures for financial planning purposes. Your actual cost of attendance, financial aid package, loan eligibility, and funding gap may differ materially from the estimates provided. Our collection and presentation of tuition, fees, living expenses, and other cost-of-attendance data from U.S. colleges and universities may contain errors. You should always verify your actual cost of attendance, financial aid package, and funding gap directly with the financial aid office of the institution you attend or plan to attend before making any borrowing or financial planning decisions.
- Federal Loan Limits: The federal loan limits used in our calculations are based on our interpretation of applicable law and regulation. Actual borrowing limits depend on factors including your enrollment status, program classification, prior borrowing history, and institutional certification.
- No Guarantee of Loan Availability: The display of a calculated funding gap does not constitute a guarantee that private loans for that amount are available to you or that you will qualify for any particular loan product, rate, or term.
- No Storage of Personal Information by Calculator: The standard Calculator does not require you to input personally identifiable information. If you voluntarily provide your email address to receive a funding plan or other communication, that information is handled in accordance with our Privacy Policy.
- Legislative and Regulatory Changes: The federal student loan limits, borrowing caps, and regulatory frameworks referenced by our Calculator and content are based on current law, including Public Law 119-21 (the "One Big Beautiful Bill Act") and applicable provisions of the Higher Education Act. Federal loan limits and regulations are subject to change at any time by legislative or regulatory action, including amendments, repeal, executive orders, or rulemaking by the U.S. Department of Education. We do not guarantee that the loan limits, cap structures, or regulatory classifications displayed on our Sites reflect real-time legislative or regulatory status. It is your responsibility to verify current federal loan limits with the financial aid office of the institution you attend or plan to attend, or with the U.S. Department of Education, before making financial decisions.
7. Intellectual Property
All content on the Sites, including but not limited to text, articles, data compilations, data reports, calculator tools, software code, graphics, logos, page layouts, and design elements, is the property of The Gap Funding Group LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may:
- Access and view our content for personal, non-commercial use
- Share links to our content
- Reference our data with appropriate attribution to the applicable Site
You may not, without our prior written consent:
- Reproduce, distribute, or republish substantial portions of our content
- Scrape, data-mine, or use automated tools to extract data from our Sites
- Copy, modify, or create derivative works based on our calculator tool or underlying software
- Use our trademarks, logos, or brand names in any manner that suggests endorsement or affiliation
- Frame, embed, or mirror our Sites or any portion thereof on another website, except as expressly permitted through our authorized embed program
The data compilations available on our Sites, including our cost-of-attendance dataset and calculated funding gap figures, represent substantial original effort in collection, verification, and organization. These compilations are protected under applicable copyright and database rights.
8. User Conduct
By using the Services, you agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to any portion of the Sites, other accounts, computer systems, or networks connected to the Sites
- Use any automated system, including bots, crawlers, or scrapers, to access the Sites for any purpose without our express written permission
- Transmit any viruses, worms, or other malicious code
- Interfere with or disrupt the integrity or performance of the Sites
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
- Use the Services to compile data for use by any competitor or for any commercial purpose without our prior written consent
9. Email Communications
If you provide your email address through our Sites (including through the Calculator, newsletter signup, or other form), you consent to receive electronic communications from us. These communications may include:
- Your funding gap results and financial planning information
- Educational content about student loans, financial aid, and higher education costs
- Information about private lending options and rate updates
- Promotional communications from the Company
Marketing and promotional emails will be clearly identified as such and will include our physical mailing address or registered agent information in compliance with the CAN-SPAM Act. You may unsubscribe from our marketing emails at any time by clicking the "unsubscribe" link at the bottom of any email. We will process unsubscribe requests within ten (10) business days. Unsubscribing from marketing emails does not affect transactional emails related to a specific request you have made (such as delivery of a funding plan PDF you requested).
10. Privacy
Your use of the Services is also governed by our Privacy Policy, which is available on each Site and incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding the collection, use, and disclosure of your information.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT, DATA, OR CALCULATOR RESULTS PROVIDED THROUGH THE SERVICES
- WARRANTIES REGARDING THE RATES, TERMS, OR AVAILABILITY OF ANY THIRD-PARTY PRODUCT OR SERVICE REFERENCED ON THE SITES
THE COMPANY DOES NOT WARRANT THAT THE DATA IN OUR CALCULATOR OR CONTENT REFLECTS CURRENT INSTITUTIONAL PRICING. TUITION, FEES, AND LIVING EXPENSE FIGURES CHANGE PERIODICALLY AND MAY DIFFER FROM THE FIGURES DISPLAYED ON OUR SITES.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE GAP FUNDING GROUP LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR USE
- DAMAGES ARISING FROM YOUR RELIANCE ON ANY INFORMATION PROVIDED THROUGH THE SERVICES
- DAMAGES ARISING FROM YOUR INTERACTION WITH ANY THIRD-PARTY LENDER, MARKETPLACE, OR SERVICE PROVIDER LINKED FROM OUR SITES
- DAMAGES ARISING FROM ANY ERRORS OR INACCURACIES IN OUR CALCULATOR RESULTS, DATA, OR CONTENT
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WE ARE NOT A LENDER, LOAN BROKER, OR FINANCIAL INSTITUTION. WE DO NOT MAKE CREDIT DECISIONS. WE ARE NOT RESPONSIBLE FOR ANY ERRORS, OMISSIONS, OR DELAYS IN THE LOAN APPLICATION PROCESS CONDUCTED BY THIRD-PARTY LENDERS, NOR FOR ANY TERMS, RATES, FEES, DENIALS, OR DECISIONS MADE BY SUCH LENDERS. ANY LOAN AGREEMENT YOU ENTER INTO IS SOLELY BETWEEN YOU AND THE LENDER. WE HAVE NO ROLE IN AND ACCEPT NO LIABILITY FOR THE LENDING PROCESS, LOAN SERVICING, COLLECTIONS, OR ANY DISPUTE BETWEEN YOU AND A LENDER.
IN ANY EVENT, THE COMPANY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
13. Indemnification
You agree to indemnify, defend, and hold harmless The Gap Funding Group LLC, its members, managers, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or access to the Services in violation of these Terms
- Your violation of any applicable law or regulation
- Any claim by a third party (including a lender) arising from your actions after leaving our Sites
- Any dispute between you and a third-party lender, marketplace, or service provider
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Informal Resolution: Before filing any formal proceeding, you agree to first contact us at legal@gapfundinggroup.com and attempt to resolve the dispute informally for at least thirty (30) days.
Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, or at another mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Services after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
16. Termination
We reserve the right to suspend or terminate your access to the Services at any time, for any reason, without notice or liability. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7 (Intellectual Property), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), 14 (Governing Law and Dispute Resolution), and 19 (Assignment).
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
18. Force Majeure
The Company shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, government actions or orders, legislative or regulatory changes (including amendments to or repeal of Public Law 119-21 or related federal student loan regulations), failure of third-party hosting or infrastructure providers, cyberattacks, power outages, or internet service disruptions. During any such event, our obligations under these Terms are suspended for the duration of the event.
19. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. The Company may assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, at any time without notice or your consent, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
20. Waiver
The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
21. Embedded Calculator and White-Label Use
The Company may make the Funding Gap Calculator or related tools available for embedding on third-party websites, including educational institution (.edu) websites, through an authorized embed program. The following terms apply to embedded use of our tools:
- Authorization Required: Embedding, framing, or mirroring the Calculator or any portion of our Sites on another website is permitted only with our prior written authorization or through our authorized embed program.
- No Modification: Authorized embed partners may not modify the Calculator's functionality, data, results presentation, or any disclosures (including the Affiliate Disclosure and Rate Disclaimer) that appear within the embedded tool.
- No Liability Transfer: Institutions or organizations that embed our Calculator on their websites do so at their own risk. The Company is not responsible for the context in which the embedded Calculator is presented, any additional representations made by the embedding party, or any reliance by end users on information provided through the embedded Calculator in combination with information provided by the embedding institution.
- Revocation: We reserve the right to revoke embed authorization at any time, for any reason, without notice.
- Embed partners are not agents, endorsers, or affiliates of the Company. The availability of an embedded Calculator on a third-party website does not constitute an endorsement of the Company by that institution, nor an endorsement of that institution by the Company.
22. Scholarships and Contests
The Company may from time to time offer scholarships, contests, or promotional programs through its Sites. Such programs are governed by their own official rules, which will be posted on the applicable Site. By participating in any scholarship or contest, you agree to the official rules for that program. In the event of a conflict between these Terms and any scholarship or contest official rules, the official rules shall control with respect to that program.
23. Entire Agreement
These Terms, together with our Privacy Policy, Affiliate Disclosure, Rate Disclaimer, and any applicable scholarship or contest official rules, constitute the entire agreement between you and the Company regarding your use of the Services and supersede all prior agreements, representations, and understandings.
